The Pension/ CCS (Pension) Rule 1972 is a set of regulations that govern the calculation and payment of pension to retired government employees in India. These rules provide guidelines for determining the pension amount and other related benefits based on the employee’s length of service and average emoluments.

The pension calculation under the Pension/ CCS (Pension) Rule 1972 is based on the formula:

Pension = Average Emoluments × Qualifying Service / 80

Here, the average emoluments refer to the average of the pay drawn during the last ten months of service before retirement. It includes basic pay, dearness allowance, and non-practicing allowance, if any. The qualifying service is the number of years and completed months an employee has served in the government sector.

However, the pension amount cannot exceed half of the average emoluments or exceed the maximum limit set by the government, whichever is lower. The maximum limit is based on the last pay drawn by the employee before retirement or the applicable pay scale.

In addition to the basic pension, the pensioner may also be eligible for additional benefits such as dearness relief, commutation of a portion of the pension, and gratuity.

Dearness relief is an additional amount provided to compensate for the inflationary impact on the pension. It is calculated based on the consumer price index and is revised periodically.

Commutation of pension allows the pensioner to receive a lump sum amount by surrendering a portion of the pension. The maximum commutation allowed is 40% of the pension, while the remaining 60% is received as a monthly pension.

Gratuity is a one-time lump sum payment made to the government employee upon retirement or death while in service. The gratuity amount is determined based on the length of service and the average emoluments.

It is important to note that the calculation of pension and related benefits may vary for different types of government employees, such as civilian employees, defense personnel, and paramilitary forces. There may be additional provisions in place for disability pension, family pension, and other specific cases.

    सर मेरा एक सवाल था कि हमारे हाई कोर्ट ने एक पोस्ट ट्रांसलेटर की निकाली है और जो कि in the cadre of sr.assistant hai मगर हमारे आर एंड पी रूल के ट्रांसलेटर पद के लिए दसवीं तथा बारहवीं मैं हिंदी और इंग्लिश में 50% नंबर होने चाहिए। अब बात यह आती है कि सीनियरिटी के हिसाब से जो कर्मचारी जिसकी प्रमोशन ड्यू है उसके हिंदी और इंग्लिश में 50% नंबर नहीं है तो क्या उसे कर्मचारियों को प्रमोशन ना देकर उसके नीचे वाले जूनियर कर्मचारियों को प्रमोशन दी जा सकती है या नहीं । मेरा अपना सुझाव मेरे विभाग को यह था कि पहले हम अपने कर्मचारियों की सीनियर असिस्टेंट के लिए प्रमोशन करें और उसके बाद जो भी सीनियर असिस्टेंट 50% नंबर वाला है उसे ट्रांसलेटर के पद पर रखा जाए इससे न तो सीनियारिटी लिस्ट में फर्क पड़ेगा और ना ही कोई कर्मचारी पदोन्नति से वंचित रहेगा।
