Division of Assets – Preventing Spousal Impoverishment




Figuring out how to fund the cost nursing home care can be extremely stressful. When one spouse needs nursing home care, paying for the carets can have a big impact on the well spouse’s financial status. Paying for care without impoverishing the well spouse can be quite difficult. There are provisions in the federal law that are designed to help protect the well not living in a nursing home or receiving Home and Community-Based Services (HCBS). This is known as division of Assets, commonly referred to as Medicaid’s spousal impoverishment laws .
