The Kerala High Court has given a significant direction to the Employee Provident Fund Organisation (EPFO) regarding higher pensions. The court has ruled that the EPFO should revise and increase the pension amount of all its employees who opted for the higher pension scheme in the year 2008.
The higher pension scheme was introduced by the EPFO in 2008, but not all employees were provided with the option to switch to this scheme. In some cases, the employees were not even informed about the scheme. This led to dissatisfaction among employees who were denied the option and led to a legal battle.
The high court has now ruled that all employees who were working before September 1, 2014, should be given the option to opt for the higher pension scheme. The EPFO has also been directed to revise and increase the pension amount of all its employees who have opted for this scheme.
This direction is a significant relief for employees who were denied the option to switch to the higher pension scheme. The court has also ordered the EPFO to calculate the pension amount based on actual contributions made by the employees and not on the basic salary.
The high court’s direction is expected to benefit around 17 lakh EPFO subscribers across the country. This decision will ensure that employees who have retired or are about to retire will receive a higher pension amount, providing them with financial stability during their golden years.
In conclusion, the Kerala High Court’s direction to the EPFO is a significant step towards ensuring financial security for employees, especially during their retirement years. The decision should be a wake-up call to all employers to take care of the welfare of their employees. The government and regulatory bodies must also work towards ensuring that the rights of employees are protected, and they are provided with all the necessary benefits and protections.
