Excellent!! Right to the point.. just what I was looking for.
My colleague was awarded his entire 401k during his divorce because it was argued his spouse had every opportunity to invest in their own retirement account. We both live in a equitable distribution state. I too will argue based on the same principals as my friend did. There should be more legal grounds to maintain one’s individual retiremement account during a divorce since the very definition of individual retirement account is ‘individual’.
