Stephanie Jenkins speaks with My Carolina Today about Alimony / Spousal Support in North Carolina

Child Support can be complicated. In North Carolina, two of the more common terms beyond spousal support are post separation support and alimony. North Carolina requires that couples be separated for one year before he/she can file for a divorce which is why post separation support may be very important. It’s possible that someone may not be entitled to long term financial support and the court could decide a one or two year time frame is sufficient to help the spouse get back on their feet. Post separation support can be given without finding that someone will get long term support.

As for long term support, that is when Alimony comes into play. Alimony will likely go to court. There will likely be a lot of emotions and issues that arise when it involves spousal support. People will often argue that they will pay anything to help their children but he/she (other spouse) is not getting a dime. It’s usually not clear cut how much someone will get or have to pay, but a good attorney can often come close in advising what amounts may have to be paid or can be expected in Alimony. The court will ultimately decide how much Alimony and for how long.

Alimony: Awarded if one spouse is dependent on another spouse. It is possible that the woman is the main provider and could have to pay the man Alimony or Spousal support. There are more men these days that could be a stay at home dad while the woman pursues a career.
