    Fundamental requirement claimet must be taking care of child. Can the claim work part time or go to school?

    With this child in care benefit would the family have to keep a record of what the money they receive was used for, like ssi?

    One thing, if they begin receiving benefits before the spouse reaches full retirement age, they will get the benefit based on FRA. But when spouse passes, the benefit reverts back to the amount the spouse received when the retired. If they retire at 62, spouse and child get amount would be at retirement. But when they pass their benefit is based on amount person was receiving by retiring early. That can mean a good bit as a survivor benefit.

    I am 64 and have been collecting SS benefits for 6 months, my 2 year old son is also collecting, no issues there, we applied for my wife's child in care benefits (she is 32) and apparently were denied after 5 months of waiting, still waiting on the letter but website shows 0 for her next payment. I have read it is not uncommon for them to deny benefits the first time you apply. We did everything right, and from their own website she is eligible as we are not at the family max yet. So looks like we will be appealing.

    Josh – My understanding is the main criteria for DAC (Disabled Adult Child) and Child in Care benefits is that the primary worker (for lack a better term) is that they themselves must be collecting social security, i.e. they must be 62 (or themselves be disabled) before the disabled adult child can begin collecting 50% of the primary’s PIA, and thus also the spouse could then also collect “Child in Care” benefits. This is my scenario almost to a “T”, I am currently 58, I have a disabled adult child, and my wife is 57, in 3.5 years when I turn 62 (and file to receive benefits) my disabled adult child will be able to begin receiving 50% of my PIA and my wife (who will be 61 at that time) will be able to receive 50% of my PIA (however both my child and wife will be limited by the family maximum). The one thing I am questioning is that you said your client’s son was approved for SSDI, but if one of his parents are not yet 62 then they would not be approved for SSDI, they could be approved as disabled but would instead be approved to receive for SSI, but would switch to SSDI when one of the parents begins claiming at 62, in your client’s case in 7 years when he turns 62. I am have not heard that the File and Suspend would work in this situation, what I have been able to find is that the primary worker must be receiving benefits for the DAC or Child in Care benefits to be paid.     Once i file for ss in january, my disabled adult child will transition from ssi to ssdi on my benefit, and my spouse will qualify for "child in care" also on my benefit subject to my family cap. My wife can also "file and suspend" her own ss benefit. My wife is 61 and can still collect a benefit.
