The Supreme Court of India recently delivered a landmark decision that has brought relief to pensioners across the country. The court ruled that pensioners who retired from government service and did not receive a promotion during their service will be entitled to a notional increment in their pension.
This decision was given by a bench of Justices L. Nageswara Rao, Hemant Gupta, and S. Ravindra Bhat in response to a petition filed by the Central Government Pensioners’ Association. The petitioners argued that pensioners who had retired from government service on or after January 1, 2006, had been wrongly denied the benefit of the notional increment.
The notional increment is a concept that was introduced by the Sixth Pay Commission in 2006. It is a virtual increase in the pension of an individual that is given when their colleagues in the same grade receive a pay hike due to a revision in salary. The increment is not actually paid to the pensioner, but it is used to calculate their pension.
The court’s decision means that pensioners who retired from government service between January 1, 2006, and June 30, 2016, will receive the benefit of the notional increment. This will be a significant relief for pensioners, as it will increase their pension and bring them closer to the pay scales of their colleagues who received promotions during their service.
The court also noted that the government had not presented any cogent reasons for denying the benefit of the notional increment to pensioners. The court observed that this decision would not result in any additional burden on the exchequer since the increment was not actual but only notional.

Rakshit ji why individual court is required to be filed. Once court case is decided in favor of employees or pensioners, then policy should be made to give benefits to all affected pensioners like me. Myself retired on 30 June.
If the employee had comitted any blunder even on 31st December or 30th Jun FN or AN of the retirement, he would have served charge sheet/Service notice till 12pm of the 30th Jun/31 Dec of the retiring day.

कोर्ट का फैसला सभी के लिए होना चाहिए ना सारे पेंशनर कब तक कोर्ट जाएंगे
